Building permits in Portugal

Portugal revised its building law, with the changes applying since 1 October 2026. Older guides and videos may no longer be right.

Permit or prior communication

Decree-Law 108/2026 sets three routes: a permit (licença), a prior communication and a prior communication with a deadline.

  • Prior communication: for example, where a detailed plan or subdivision already fixes the parameters, and in established urban areas under certain conditions.
  • Permit: works that do not fit the above, listed buildings, and areas with restrictions not set out in a plan.

Less paper

The law now refers to the "title" of the operation rather than the old paper permit (alvará). It is proved by the fee receipt, the final application and the approval notice. To use the house, you file a notice with the council instead of getting a use licence.

Councils are still adapting

Lisbon City Council itself says it is still adapting its procedures and digital services. Ask your council which forms and deadlines it is using. Madeira has its own regional version of the law, so check locally in Madeira.

Common questions

Do I still need a use licence to move in?

After permitted works, the law replaces it with a notice to the council and a statement from the site manager or supervisor.

Can I start before approval?

No. Wait for the title of the operation, or until the prior communication is in order.
