Buying land to build in Portugal
The most expensive mistake happens before the build: buying land where you cannot build what you want. Everything here can be checked before you pay a deposit.

Urban or rural
Municipal plans classify all land. The law treats land as urban if it is built on, urbanised or set aside for that in the plan. Everything else is rural: farming, forest, natural space. An advert saying "with viability" proves nothing.
Can rural land become urban?
Only in limited cases. Changes in 2024 and 2025 opened a route for housing, but it needs land next to urban areas, and most of the floor area must be public, affordable or cost-controlled housing. Do not count on it for a private villa.
Get it in writing
Anyone can file a prior information request (PIP) with the council, even if they do not own the plot, by adding a land registry certificate. Under the new text, the council decides within 15 days for a simple request and 30 for a full one, after initial screening or the last outside opinion. A favourable answer binds the council and lasts 2 years.
Documents to ask for
- Land registry certificate: the owner and any charges.
- Tax record (caderneta predial): tax details, valid for 12 months.
- PDM maps for the site, including restrictions.
Purchase taxes
Property transfer tax (IMT) is 5% for rural land and 6.5% for other urban property, which usually covers building plots. Stamp duty adds 0.8%. Buyers based in a listed tax-haven jurisdiction pay 10% IMT.
Common questions
Can I build on rural land in Portugal?
Usually very little, and it depends on the plan. In the Algarve, the regional plan is especially strict. Ask the council before you buy.
Do I need to own the land to ask the council?
No. A non-owner can file the request, with a land registry certificate.
